Mixed-use strata schemes are becoming more common with residential apartments increasingly being co-located with commercial and retail spaces. 

The Commission has heard from businesses reporting a range of concerns, including delays in obtaining required strata approvals and failures to make critical repairs. The Commission is also aware of broader concerns around the management of strata schemes which impact businesses and residents alike. 

The NSW Small Business Commissioner is calling for stronger protections to ensure that small businesses, not just homeowners, are shielded from unfair fees and mismanagement.

“Commercial tenants or landlords experiencing a problem within a strata scheme should contact the Commission to see how we may be able to help, including through our low-cost mediation services," said NSW Small Business Commissioner, Chris Lamont.

The Commission has also previously raised concerns about the need for broader property services reforms to ensure they are fit for purpose including for onsite property managers. 

“We need right-sized regulation that provides the appropriate protections where it is needed most, while minimising unnecessary regulation where the risks are low,” said Chris Lamont.
