January 2025 update from the Commission

The NSW Small Business Commission will be hosting a free online session, "Navigating Casual Employment", on Wednesday, 26 February 2025. This one-hour session features the Fair Work Ombudsman discussing recent changes to casual employment definitions, conversion entitlements, sham contracting arrangements and the Casual Employment Information Statement. Don't miss this opportunity to stay up to date.

The Commission recently launched the Digital Platforms Hub to assist small businesses utilising online marketplaces and services. This resource provides information on how to get the most out of digital platforms and guidance on how to seek support when facing challenges. Small businesses that rely heavily on digital platforms are encouraged to engage with these resources and connect with the Commission if encountering challenges.

There are a number of important changes coming into effect this year that small businesses should be aware of. These include the criminalisation of intentional underpayment of wages, superannuation and other entitlements, bans on certain plastic items, and new 'Right to Disconnect' laws. It's crucial for small businesses to familiarise themselves with these changes to ensure compliance and avoid potential penalties.

It's crucial for small businesses to understand their obligations under the Australian Consumer Law (ACL), including when a customer requests a refund or replacement. If your business sells consumer goods, it is helpful to know under what circumstances you must accept returns. 

Cash flow remains a challenge for many small businesses, and the Commission continues to receive consistent enquiries on debt and payment-related disputes. Seasonal factors can make this time of year a difficult period for many businesses, so it’s helpful to proactively manage debts. This can include reviewing statements and setting up payment plans to manage financial pressures. If you are struggling with debt, the Commission has put together a list of helpful resources to stay on top of things.

At the end of 2024, the Commission farewelled outgoing Commissioner Chris Lamont, who has accepted a new opportunity interstate. While the process to appoint a new Commissioner is underway, the Commission remains fully operational, with no impact on our services. The team at the Commission extends its best wishes to Chris and thanks him for his leadership and commitment to small business during his tenure.
