Help for both tenants and landlords at all stages of a lease

The Commission has published an update to its Retail Tenancy Guide, an essential reference for both tenants and landlords, at all stages of a lease.

NSW Small Business Commissioner Chris Lamont said: “Entering a lease is a major commitment and it is critical that small businesses understand their rights and responsibilities.” 

The guide covers many common scenarios including starting a lease, changing the rent, transferring a lease and where lessors and lessees are in dispute. It can be used as a reference at any point during the term of the lease.   

The Commissioner strongly advised getting independent and professional advice before signing a lease as different laws covered retail, commercial and residential leases and it was up to lessors and lessees to know their obligations and requirements set out within the Retail Leases Act 1994 (NSW).
