The NSW Small Business Commission offers a cost-effective mediation service to help resolve many types of disputes without the high cost and delays of going to court. Our Mediation Services team takes an active role in engaging parties to a dispute, offering them every opportunity to resolve their matter before formal mediation is necessary.
We offer mediation for issues including:
- Disputes between lessors (property owners, or landlords) and lessees (tenants) of shops, restaurants, offices, and industrial or commercial premises.
- Lease, license or contract disputes between small businesses and Government agencies or local government.
- Disagreements between contractors and subcontractors.
- Franchise disputes.
In the case of retail lease disputes, it may be a requirement under the NSW Retail Leases Act 1994 to try to resolve the issue through mediation conducted by the Commission (as the Registrar of Retail Tenancy Disputes) before proceeding to court or the NSW Civil and Administrative Tribunal.
